isima Affiliate Program Terms & Conditions
Effective Date: August 13, 2026
These Affiliate Program Terms & Conditions (“Terms”) govern participation in the isima Affiliate Program (“Program”) operated by Frutabomba d/b/a isima (“isima,” “we,” “us,” or “our”).
By applying to, joining, or participating in the Program, you (“Affiliate” or “you”) acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Program Participation
Participation in the Program is subject to approval by isima. Applicants must be at least 18 years old and legally capable of entering into a binding agreement.
isima may approve or reject any application in its discretion and may suspend or terminate an Affiliate’s participation in the Program as provided in these Terms.
Participation in the Program does not create an employment, agency, partnership, joint venture, franchise, fiduciary, or other similar relationship between the Affiliate and isima. Affiliates have no authority to make commitments, representations, or agreements on behalf of isima.
2. Affiliate Codes and Links
Approved Affiliates may receive a unique promotional code, affiliate link, or both (“Affiliate Tools”) to share with their audience.
Affiliate Tools are intended to drive genuine purchases by individual end consumers resulting from the Affiliate’s legitimate promotional efforts. They may not be sold, transferred, assigned, distributed for unauthorized purposes, or used in a manner intended to artificially generate commissions.
Affiliate codes and links remain the property of isima. isima may modify, replace, restrict, or deactivate any Affiliate Tool at any time.
3. Eligible Commission Sales
Commissions are earned only on qualifying transactions that isima, in its sole discretion, determines are eligible for commission under the Program.
Unless otherwise communicated in writing by isima, commissions are calculated on the net product sales amount actually paid by the customer after discounts, excluding taxes, shipping and delivery charges, gift cards, credits, refunds, returns, chargebacks, and other non-product charges.
A transaction is not eligible for commission if isima determines that it is:
- canceled, refunded, returned, charged back, fraudulent, duplicated, or otherwise invalid;
- placed by the Affiliate for their own benefit;
- placed for or by a member of the Affiliate’s household or business for the purpose of generating commission;
- placed by or on behalf of another individual at the Affiliate’s direction for the purpose of generating commission;
- generated through unauthorized advertising, promotion, or distribution of an Affiliate code or link;
- associated with unauthorized coupon, discount, deal, or code-aggregation websites, browser extensions, or similar services;
- generated through manipulation, fraud, abuse, or misuse of the Program;
- intended, in whole or in part, for resale or commercial redistribution; or
- otherwise determined by isima to be inconsistent with the purpose or intent of the Program.
Resale and Commercial Purchases
Affiliate commissions are intended for purchases made by individual end consumers for personal use. Orders placed for resale, wholesale, redistribution, marketplace sales, commercial fulfillment, or any other commercial purpose are not eligible for commission.
isima may determine that an order or group of orders is intended for resale or commercial use based on any information or purchasing pattern isima considers relevant, including, without limitation:
- unusually large quantities;
- repeated orders for the same or similar products;
- multiple orders placed within a short period;
- coordinated purchases;
- purchases intended to circumvent product quantity limits;
- shipping to warehouses;
- shipping to freight forwarders;
- shipping to fulfillment centers;
- shipping to known or suspected commercial resellers or marketplace sellers;
- common addresses, payment methods, customer information, or other characteristics across multiple orders; or
- any other activity that isima believes reasonably indicates commercial resale or redistribution.
isima may cancel, withhold, reverse, or exclude commissions associated with such transactions, including commissions that initially appeared as tracked, pending, attributed, credited, or approved.
4. Attribution and Commission Rates
Commission rates are established by isima and may vary by Affiliate, product, campaign, promotion, Program tier, or other criteria.
Current commission rates will be communicated through Superfiliate or directly by isima.
isima may modify commission rates prospectively at any time. Unless otherwise communicated, a changed commission rate will apply to qualifying transactions occurring after the change becomes effective.
Superfiliate or another platform designated by isima may be used to track Affiliate referrals and attribute transactions. Tracking or attribution by Superfiliate does not independently establish that a commission has been earned or is payable.
Where multiple affiliate codes, links, marketing channels, discounts, or other attribution sources are associated with a transaction, isima retains sole discretion to determine whether the transaction is commissionable and, if so, to whom the commission will be attributed.
5. Commission Review and Payment
All transactions and commissions are subject to review and validation by isima before payment.
Commissions will remain pending for at least 30 days following the applicable purchase to allow for returns, cancellations, chargebacks, fraud review, reseller review, Program compliance review, and other validation.
A commission appearing as pending, tracked, attributed, credited, approved by an automated system, or otherwise reflected within Superfiliate does not by itself constitute final approval of the commission or an obligation by isima to pay it.
Only commissions ultimately determined by isima to be valid and eligible are payable.
Approved commissions will be processed monthly and are generally payable within 30 days following the end of the calendar month in which they are approved, provided that the Affiliate has supplied all required payment, identity, and tax information.
Payment timing may be delayed where:
- additional review or investigation is required;
- payment or tax information is missing, inaccurate, or incomplete;
- a transaction or commission is disputed;
- a payment cannot be successfully processed;
- isima suspects fraud, abuse, resale, Program misconduct, or other prohibited activity; or
- isima determines that additional validation is appropriate.
isima may, in its sole discretion and to the fullest extent permitted by applicable law, withhold, reverse, offset, cancel, or otherwise deem ineligible any commission associated with a transaction or activity that isima determines does not qualify under these Terms.
Payments will be made through Superfiliate or another payment method designated by isima.
Affiliates are responsible for maintaining accurate payment and tax information necessary to receive payment.
6. Coupon and Promotional Code Distribution
Affiliate codes and links may only be promoted through channels reasonably associated with the Affiliate and their legitimate promotional activities.
Unless isima provides prior written authorization, Affiliates may not intentionally submit, distribute, publish, or cause their Affiliate Tools to appear on:
- coupon sites;
- deal sites;
- discount-code aggregators;
- browser extensions;
- cashback or rewards services;
- paid-search advertisements;
- unauthorized third-party promotional platforms; or
- similar services designed primarily to distribute, aggregate, or discover promotional codes.
If an Affiliate becomes aware that their code or link has been published on an unauthorized third-party platform, the Affiliate should promptly notify isima.
isima may withhold, reverse, cancel, or otherwise deem ineligible commissions resulting from unauthorized code or link distribution.
7. Paid Advertising and Search
Unless isima provides prior written approval, Affiliates may not:
- bid on “isima,” isima product names, isima trademarks, or misspellings, variations, or combinations of those terms in paid search;
- purchase advertisements that impersonate or could reasonably be mistaken for official isima advertising;
- use an isima Affiliate link as the destination for paid-search advertising;
- purchase social-media advertising using isima trademarks or creative without authorization;
- represent themselves as isima, an official isima account, or an employee or authorized representative of isima; or
- use isima trademarks in domain names, social-media usernames, account names, or similar identifiers without written authorization.
8. Affiliate Disclosures
Affiliates must comply with all applicable advertising, endorsement, and disclosure laws and regulations, including the Federal Trade Commission’s Endorsement Guides.
Affiliates must clearly and conspicuously disclose their relationship with isima whenever they promote, recommend, review, endorse, or otherwise discuss isima or isima products in circumstances where disclosure is required.
A material relationship may include receiving:
- commissions;
- payment;
- free products;
- discounted products;
- gifts;
- travel;
- services; or
- any other financial or non-financial benefit from isima.
Disclosures must be understandable to the ordinary consumer and placed where consumers are likely to notice them in connection with the applicable content.
Where appropriate, disclosures may include clear language such as “Ad,” “Sponsored,” “I earn a commission from purchases,” or another clear statement explaining the Affiliate’s relationship with isima.
Affiliates may not rely solely on a social-media platform’s disclosure tool where additional disclosure is reasonably necessary to make the relationship clear.
9. Truthful Content and Product Claims
Affiliates must provide honest opinions, findings, beliefs, and experiences.
Affiliates may not make statements about isima or isima products that are false, misleading, deceptive, unsupported, or inconsistent with information provided or approved by isima.
Affiliates may not make unauthorized medical, therapeutic, health, performance, ingredient, environmental, sustainability, comparative, or other product claims.
Affiliates may only describe personal experiences they have actually had and may not falsely claim to have used a product.
Affiliates are responsible for ensuring that their content complies with applicable laws, regulations, advertising requirements, and the rules of the platforms on which the content appears.
isima may request the removal, correction, or modification of Affiliate content that isima believes violates these Terms, applicable law, platform requirements, or isima brand standards. The Affiliate agrees to reasonably comply with such requests.
10. isima Brand and Intellectual Property
isima grants Affiliates a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to use approved isima trademarks, product images, logos, and other approved brand assets solely for legitimate participation in the Program.
Affiliates may not:
- materially alter isima trademarks or logos;
- register or use domain names containing isima trademarks;
- create social-media accounts that could reasonably appear to be official isima accounts;
- imply ownership of isima intellectual property;
- imply an affiliation with isima beyond participation in the Affiliate Program; or
- use isima intellectual property in a way that is misleading, defamatory, unlawful, or inconsistent with isima brand standards.
All rights not expressly granted under these Terms remain the property of isima and its licensors.
11. Affiliate Content
The Affiliate retains ownership of original content they create, subject to any third-party rights contained in that content.
By publicly posting content promoting isima in connection with participation in the Program, the Affiliate grants isima a non-exclusive, royalty-free right to repost, share, and display that content through isima-owned organic social-media channels and other isima-owned digital channels, with reasonable attribution where practicable.
This license does not, by itself, grant isima the right to use Affiliate content in paid advertising, whitelisting, paid amplification, or other paid media. Any such usage rights may be agreed upon separately between isima and the Affiliate.
The Affiliate represents that they have the rights necessary to publish content they submit or post in connection with the Program.
12. Prohibited Conduct
Affiliates may not engage in any conduct that isima determines to be fraudulent, deceptive, abusive, manipulative, unlawful, inappropriate, harmful to isima, or inconsistent with the purpose or integrity of the Program.
Prohibited conduct includes, without limitation:
- generating artificial, fraudulent, or self-referred transactions;
- making purchases for the purpose of generating commission for oneself;
- arranging or coordinating purchases through family members, household members, employees, businesses, friends, or other third parties primarily for the purpose of earning commission;
- purchasing products for resale;
- facilitating or knowingly encouraging reseller, wholesale, distributor, or marketplace purchases;
- sharing codes or links with resellers, distributors, wholesalers, marketplace sellers, or similar commercial purchasers;
- splitting or coordinating orders in an attempt to evade quantity limits, resale detection, or Program controls;
- intentionally distributing codes through unauthorized coupon or discount channels;
- using bots, automated traffic, cookie stuffing, forced clicks, adware, spyware, or similar techniques;
- manipulating attribution or tracking;
- impersonating isima;
- making false or misleading representations about isima or its products;
- sending unsolicited commercial communications in violation of applicable law;
- promoting expired, unauthorized, fabricated, or inaccurate discounts or offers;
- interfering with another Affiliate’s referrals or attribution;
- attempting to circumvent Program policies or technical controls; or
- engaging in conduct that isima determines could harm isima’s reputation, customer relationships, retail relationships, distribution strategy, or commercial interests.
13. Monitoring, Determinations and Enforcement
isima may review Affiliate activity, traffic sources, transactions, purchasing patterns, promotional methods, shipping information, customer information, attribution data, and any other information isima deems relevant to the administration, security, and protection of the Program.
To the fullest extent permitted by applicable law, isima retains sole and absolute discretion to determine whether any activity, transaction, conduct, promotional practice, purchasing pattern, or other behavior constitutes fraud, abuse, misuse, misconduct, manipulation, unauthorized activity, a violation of these Terms, or conduct inconsistent with the purpose or intent of the Program.
The examples of prohibited or ineligible conduct described in these Terms are illustrative and are not exhaustive. Conduct does not need to be expressly identified or prohibited in these Terms for isima to determine, in its sole discretion, that the conduct is inappropriate, abusive, manipulative, inconsistent with the intent of the Program, harmful to isima, or otherwise ineligible for commission.
isima retains sole discretion to determine:
- whether a transaction qualifies for commission;
- whether a transaction was generated through legitimate Affiliate activity;
- whether an order is intended for resale or commercial redistribution;
- whether an Affiliate has engaged in misconduct or Program abuse;
- how a transaction will be attributed;
- whether a pending, tracked, attributed, credited, or previously approved commission remains eligible for payment; and
- what remedial or enforcement action is appropriate.
If isima determines that an Affiliate has engaged in prohibited, inappropriate, abusive, or otherwise unacceptable conduct, isima may take any action it deems appropriate, including:
- withholding, canceling, or reversing commissions;
- offsetting amounts against future payments;
- excluding individual transactions or groups of transactions from commission eligibility;
- modifying or deactivating promotional codes or links;
- suspending the Affiliate’s account;
- immediately terminating the Affiliate’s participation in the Program; or
- taking any other action isima determines is reasonably necessary to protect isima, its customers, retail partners, commercial interests, or the integrity of the Program.
All determinations made by isima regarding Program compliance, misconduct, transaction eligibility, attribution, and commission eligibility are final and binding to the fullest extent permitted by applicable law.
14. Suspension and Termination
Either the Affiliate or isima may end the Affiliate’s participation in the Program at any time.
isima may suspend or terminate an Affiliate immediately if isima determines that the Affiliate has violated these Terms, engaged in misconduct, or otherwise acted in a manner inconsistent with the interests or integrity of the Program.
Upon termination, the Affiliate must stop representing themselves as an isima Affiliate and discontinue use of Affiliate Tools and any isima materials that isima requests be discontinued.
Termination does not automatically entitle an Affiliate to payment of commissions that are pending, under review, disputed, or subsequently determined to be ineligible.
Commissions validly earned before termination may be paid following isima’s normal validation and payment process. However, isima is not required to pay commissions associated with violations of these Terms, including violations identified after termination.
Provisions of these Terms that by their nature should survive termination will survive, including provisions relating to commission validation, intellectual property, liability, governing law, and amounts owed or withheld.
15. Changes to the Program or These Terms
isima may modify, suspend, discontinue, or otherwise change the Program at any time, including commission rates, eligibility criteria, promotional restrictions, product eligibility, payment procedures, Affiliate Tools, and Program benefits.
isima may also modify these Terms from time to time.
Updated Terms will become effective upon the effective date stated in the revised Terms or when otherwise communicated to Affiliates.
Continued participation in the Program after revised Terms become effective constitutes acceptance of the revised Terms.
If an Affiliate does not agree to revised Terms, the Affiliate’s remedy is to discontinue participation in the Program.
16. Taxes
Affiliates are solely responsible for any federal, state, local, foreign, or other taxes arising from compensation received through the Program.
Affiliates must provide any tax documentation, identification, certifications, or other information reasonably required by isima, Superfiliate, or a designated payment provider before receiving payment.
isima may withhold payment where required documentation has not been provided.
17. Disclaimer and Limitation of Liability
The Program and any related technology, tracking, links, codes, dashboards, reports, or services are provided on an “as is” and “as available” basis to the fullest extent permitted by applicable law.
isima does not guarantee any particular level of sales, commissions, traffic, earnings, Program availability, or tracking accuracy.
To the fullest extent permitted by applicable law, isima will not be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages arising out of or relating to participation in the Program, including lost profits, lost revenue, lost data, or anticipated commissions.
To the fullest extent permitted by applicable law, isima’s aggregate liability arising out of or relating to the Program will not exceed the amount of commissions actually paid to the Affiliate under the Program during the six months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.
18. Indemnification
To the fullest extent permitted by applicable law, the Affiliate agrees to indemnify, defend, and hold harmless Frutabomba d/b/a isima and its affiliates, officers, directors, employees, agents, successors, and assigns from and against third-party claims, damages, liabilities, losses, costs, and reasonable expenses arising out of or relating to:
- the Affiliate’s violation of these Terms;
- the Affiliate’s violation of applicable law;
- content or claims created or published by the Affiliate;
- the Affiliate’s infringement or alleged infringement of a third party’s intellectual property or other rights; or
- the Affiliate’s fraud, misconduct, negligence, or misuse of the Program.
19. Governing Law
These Terms and any dispute arising out of or relating to the Program will be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles.
20. Severability and Waiver
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.
isima’s failure to enforce any provision of these Terms on any occasion does not constitute a waiver of that provision or isima’s right to enforce it in the future.
21. Entire Agreement
These Terms, together with any written commission terms, campaign-specific terms, or other written terms expressly provided by isima to the Affiliate, constitute the agreement between isima and the Affiliate concerning participation in the Program.
If campaign-specific terms expressly conflict with these Terms, the campaign-specific terms will control solely with respect to that campaign to the extent of the conflict.
